1Who this agreement is between#
TOPIT is operated by [TO CONFIRM: the registered legal name of the business operating TOPIT, and its Companies Commission of Malaysia (SSM) registration number], of [TO CONFIRM: the registered business address to publish in these terms]. In these terms, “we” and “us” mean that business, and “you” means the person who opens the account.
By creating an account, or by using the service, you accept these terms. If you do not accept them, do not create an account.
Our Privacy Policy explains what we do with personal data and forms part of this agreement.
2Who may open an account#
The account holder must be an adult — at least 18 years old — and must be the parent or legal guardian of every child added to the account, or have that person’s permission.
Children do not enter into this agreement. A child plays under a profile you create, on the terms you set. The subscription is yours, the billing relationship is yours, and the consent that lets us hold data about your child is yours to give and to withdraw.
The service is built for Malaysia. Prices are in Malaysian ringgit, the payment methods are Malaysian, and the curriculum content is aligned to the Malaysian KSSR syllabus.
3Your account and your child profiles#
You are responsible for what happens under your account, including keeping your sign-in details to yourself. Tell us straight away if you think someone else has access to it.
You may add more than one child. Each child gets their own profile — a name you choose, an age band, an optional avatar, a username and a PIN — and each child needs their own subscription to keep playing once their trial or paid period ends.
The name you give a child appears in the app, in the weekly reports we email you, and on the in-game leaderboards other children can see. Choose it with that in mind; the Privacy Policy explains exactly what is visible.
4Your child’s username and PIN#
Your child signs in with a username and a four-digit PIN. We show you the PIN once, when it is created or reset, and never again — it is stored only as a salted hash, so we cannot look it up for you. If it is lost, you reset it from the dashboard.
Keeping those credentials within your household is your responsibility. Anyone who has them can play as your child and see what your child sees.
5What the service is, and what it is not#
TOPIT provides curriculum-aligned learning games in Matematik, Bahasa Malaysia, Bahasa Inggeris, Sains, Sejarah and Singapore Math, for two age bands — 4–6 and 7–12 — together with a parent dashboard where you set goals, cap daily screen time, choose the hours play is allowed, read a weekly report and manage billing.
We do not promise any particular educational outcome. The content is aligned to the KSSR syllabus, but the service is a practice and motivation tool, not a tutor, not a school and not a substitute for either. It does not predict or guarantee examination results.
In-game coins, experience points, levels, streaks and badges have no monetary value. They cannot be bought with real money, sold, transferred between children, or exchanged for anything outside the game, and we may adjust how they are earned as the games change.
Not every subject listed in the product is playable yet. Where a subject is marked as coming soon, it is not part of what you are paying for until it is live.
6The free trial#
The first child you add to a new account starts on a 7-day free trial. It requires no card and no payment details of any kind, and there is nothing to cancel if you decide to stop — when the trial ends, access simply stops.
The trial is once per account and applies to the first child only. Children added afterwards need a paid subscription to play. If you pay for a child while their trial is still running, the trial ends at that moment and the paid period starts.
7Prices, plans and what you pay#
A subscription is per child, and you choose monthly or yearly. Today the plans are:
- Monthly — RM 29 per child, charged for each month.
- Yearly — RM 240 per child, charged for each year, which works out at RM 20 per month.
Prices are shown to you in full before you pay, and the price displayed at checkout is the price that applies. We may change prices; a change never affects a period you have already paid for. [TO CONFIRM: how much notice we commit to giving before a price change, and how that notice is delivered]
Payment methods and the gateway fee
You pay through a payment gateway on its own hosted page. We never see your card number, your online-banking login or your e-wallet credentials. Most methods add the gateway’s own fee to your total, and we show you that fee as a separate line before you confirm:
- Online Banking (FPX) — gateway fee RM1.08.
- DuitNow QR & e-Wallet (DuitNow QR) — gateway fee 1.6%, minimum RM0.15.
- Boost PayFlex QR (Boost PayFlex) — gateway fee 1.6%, minimum RM0.15.
- Credit / Debit Card (Card) — gateway fee RM1.08 + 1%.
- Pay with Chip (Chip) — no gateway fee is added; we absorb the gateway’s cut on this method.
[TO CONFIRM: whether the subscription prices above are inclusive or exclusive of Sales and Service Tax, and whether the business is SST-registered — the gateway fees quoted are SST-inclusive, the subscription price is not stated either way]
Where a coupon applies, the discount is shown before you pay and applies to the period it is redeemed against, not to later ones.
8Renewal — please read this one#
This clause exists because the honest answer is not the one most subscription services would give.
Nothing renews automatically today. Every payment is a one-off charge for one period. We do not hold a card on file, we do not set up a direct debit, and we will never charge you again without you starting a new payment yourself. When the period you paid for ends, access for that child stops until you pay for another one.
We will send you a reminder before a period ends, so that you can renew if you want to. Access ends at the end of the paid period whether or not you saw the reminder.
If we introduce automatic renewal in the future — the product is built with it in mind — we will ask for your agreement before taking any recurring payment, and we will update these terms first.
9Cancelling, lapsing and refunds#
You can cancel a subscription from your dashboard at any time. Cancelling stops a subscription being carried forward and leaves your access running to the end of the period you have already paid for. Because nothing renews on its own, cancelling is mostly a way of telling us you are finished — there is no scheduled charge for it to stop.
When a period ends without a new payment, the child’s access is locked. Their profile, their progress, their badges and their streak are all kept, so paying again picks up where they left off rather than starting over.
Refunds
[TO CONFIRM: the refund policy. No refund terms exist anywhere in the product or its documentation today, and the pre-launch checklist lists a refund policy as outstanding. This needs a decision on: whether a cooling-off period applies, whether part-used periods are refundable, whether the yearly plan is treated differently, and who absorbs the gateway fee on a refund]
Where we do refund a payment, it goes back through the gateway to the method it was taken from, and the related subscription ends.
Closing your whole account
Closing your account is handled by our support team rather than by a button, because it deletes every child profile, all of their progress, your subscriptions and your payment history at once, and any live subscription has to be stopped at the gateway first. The Privacy Policy describes the process and what survives it.
10Acceptable use#
You agree not to:
- share, resell or sublicense access, or let anyone outside your household use a child profile you created;
- choose a child display name that is offensive, impersonates someone, or is designed to be seen by other children as an advertisement or a message;
- interfere with the service or try to reach parts of it you have not been given access to, including other families’ data or the administration area;
- automate, scrape or bulk-extract the questions, games or any other content;
- attempt to manipulate scores, leaderboards, rewards, coupons or billing, whether through the app or by calling our interfaces directly;
- use the service for anything unlawful.
11Content and intellectual property#
The games, the questions, the artwork, the software and the TOPIT name and logo belong to us or to our licensors. Your subscription gives your household a personal, non-transferable right to use them for the period it covers, and nothing more.
What you create in the service — a child’s display name, the goals and rewards you write — stays yours. You give us permission to store and display it inside the service so that it can do its job, including showing a display name on a leaderboard.
[TO CONFIRM: whether any question content, game mechanics, artwork, sound or fonts are licensed from third parties, and what attribution or licence terms have to be reproduced here]
12The messages we send you#
We send you service messages you cannot switch off — payment receipts, reminders that a period is ending, and anything we are required to tell you. Everything else is under your control in the dashboard: the weekly report, and each of the event notifications.
The settings screen lets you choose WhatsApp as a channel, but WhatsApp messages are not being delivered yet. Until that is live, everything arrives by email regardless of the channel you pick. The dashboard says so too.
We never message your child. Every notification goes to the account holder.
13Availability and changes to the service#
We work to keep the service running, but we do not promise uninterrupted availability. It depends on third parties — hosting, the database, the payment gateways, the email provider — and any of them can have an outage. We may also take it down for maintenance.
The service is early in its life and it will change. We may add, alter or remove games, subjects, badges and features. If we remove something significant that you are paying for, and cannot offer a reasonable equivalent, contact us.
14Suspension and closing accounts#
We may suspend or close an account that breaks these terms, that is being used to harm another user or a child, or where we are required to by law. Where it is safe and reasonable to do so, we will tell you first and give you a chance to put it right.
You can stop using the service at any time, and ask us to close your account as described above.
15Disclaimers and the limits of our liability#
The service is provided as it is. Beyond what these terms say, and to the extent the law allows, we do not give any other warranty — in particular we do not warrant that the service will be uninterrupted, error-free, or that it will produce any particular learning result.
Nothing in these terms limits liability that cannot be limited under Malaysian law, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for indirect or consequential loss, for lost profits, or for loss of data beyond what we are responsible for as described in the Privacy Policy.
[TO CONFIRM: the cap on our total liability — commonly the amount paid in the twelve months before the claim, but this needs a deliberate decision and a check that it is enforceable under the Consumer Protection Act 1999 for a consumer contract]
16Governing law and disputes#
These terms are governed by the laws of Malaysia. Our handling of personal data is governed by the Personal Data Protection Act 2010.
If something goes wrong, please contact us first — most things are settled faster that way than through a formal process.
[TO CONFIRM: the forum for a dispute that cannot be settled informally — the courts of Malaysia, and if so which, or a named arbitration body. Note that a consumer may in any case bring a claim to the Tribunal for Consumer Claims Malaysia]
17Changes to these terms#
We may change these terms as the service changes. When we do, we will update the date at the top of this page, and where a change materially affects what you pay or what you get, we will tell account holders by email before it takes effect.
Continuing to use the service after a change takes effect means you accept the revised terms. If you do not, you may close your account.
18How to contact us#
Questions about these terms, about your subscription, or about closing your account go to [TO CONFIRM: the monitored support email address. The address currently shown in the app, support@topit.my, was invented during development and does not exist], or by post to [TO CONFIRM: the registered business address for written correspondence].
